1. Acceptance of Terms
By accessing and using Smart Lead Lab ("Service"), you accept and agree to be bound by the terms and provision of this agreement. If you do not agree to abide by the above, please do not use this service.
These Terms of Service ("Terms") govern your use of our website located at smartleadlab.com (the "Service") operated by Smart Lead Lab, LLC ("us", "we", or "our").
2. Description of Service
Smart Lead Lab is an AI-powered sales and marketing automation platform that provides:
- AI content generation for social media and marketing materials
- Customer relationship management (CRM) tools
- Multi-channel outreach automation
- Voice AI and auto-dialing capabilities
- Insurance-specific underwriting and quote generation tools (for applicable plans)
- Analytics and reporting features
3. User Accounts and Registration
To access certain features of the Service, you must register for an account. You agree to:
- Provide accurate, current, and complete information during registration
- Maintain and promptly update your account information
- Maintain the security of your password and accept responsibility for all activities under your account
- Notify us immediately of any unauthorized use of your account
4. Subscription Plans and Billing
4.1 Plan Types
We offer multiple subscription tiers:
- Professional Plan: $79/month
- Business Plan: $179/month
- Enterprise Plan: $399/month
4.2 Trial Credits
Eligible workspace subscription plans may include a free trial (including a 7-day trial) with a limited number of trial credits to explore the platform. Trial credits are limited, do not roll over, and may be subject to fair use and abuse prevention measures.
- Workspace trial: 100 trial credits during the trial period.
- SMS during trial: outbound SMS features are disabled during the workspace trial period. After the trial converts to a paid subscription, SMS features may be available based on your plan and subject to compliance requirements (including A2P 10DLC registration/verification where applicable).
- AI Receptionist trial: eligible AI Receptionist subscriptions include a 10-minute free trial of calls before billable usage begins.
4.3 Monthly Credits and Rollover
Paid subscription plans include a monthly credit allocation that refreshes each billing cycle. Unused monthly plan credits roll over for up to one (1) month only. Purchased credit add-ons (if available) do not expire.
Trial credits are separate from paid monthly credits. Using all trial credits does not release a paid monthly allocation. Monthly plan credits become available only after Stripe confirms the applicable paid subscription or payment state. Where a promotion provides a $0 or discounted first period, availability follows the disclosed promotion and the confirmed billing state for that subscription.
4.4 Billing, Cancellation, and No-Refund Policy
Subscriptions are billed monthly in advance after any applicable trial period ends. If a trial is offered, we may collect billing details to start the trial and you may not be charged until the trial ends (if applicable). You may cancel your subscription at any time through your account settings or by contacting customer support. Cancellation stops future renewal and takes effect as displayed in Billing; it does not reverse charges already incurred, completed usage, or used credits.
All subscription fees, credit purchases, promotional-period charges, add-ons, and usage charges are final and non-refundable. We do not provide prorated refunds, partial-period credits, or refunds because a customer did not use the Service, a feature did not meet expectations, or a third-party provider was unavailable or produced an unwanted result. This policy applies except where a refund is required by applicable law or Smart Lead Lab expressly agrees otherwise in writing.
Cancellation takes effect at the end of your current paid billing period. Until that date, you may continue using the subscribed services and any remaining plan credits, subject to these Terms and applicable usage limits. Your subscription will not renew, you will not be charged for the next billing period, and access to subscription features ends when the current paid period expires.
4.5 Payment Processing
We accept major credit cards and debit cards for payment. All payment processing is handled securely through our third-party payment processor (Stripe). We do not store your complete credit card or debit card information on our servers. By providing payment information, you authorize us to charge your payment method for all fees incurred.
4.6 Automatic Renewal
Your subscription will automatically renew each billing cycle unless you cancel. You will be charged the then-current subscription fee for your selected plan. We will provide notice of any fee changes at least 30 days in advance. Continued use of the Service after fee changes constitutes acceptance of the new fees.
Before enrollment, the checkout flow will disclose the material terms of any trial, promotional period, recurring charge, renewal frequency, amount or method for determining the amount, and how to cancel. You must take an affirmative action to enroll. We retain records of enrollment consent as required by applicable law, and cancellation must be available through Settings > Billing or another method clearly disclosed at enrollment.
4.7 Failed Payments
If payment fails, we will attempt to charge your payment method again. If payment continues to fail, your account may be suspended or terminated. You remain responsible for any unpaid fees. We may use collection agencies or legal action to collect unpaid amounts.
5. Acceptable Use Policy
You agree not to use the Service to:
- Violate any applicable laws or regulations
- Send spam, unsolicited communications, or violate anti-spam laws
- Infringe on intellectual property rights of others
- Upload malicious code or attempt to compromise system security
- Harass, abuse, or harm other users
- Use the Service for any illegal or unauthorized purpose
- Attempt to reverse engineer or access source code
Automated Calls, SMS, and AI Receptionist
If you use calling, SMS, recording, transcription, or AI receptionist features, you are responsible for configuring and operating them lawfully. Before contacting a person, you must have a valid legal basis and any consent required by applicable telemarketing, automated calling, text messaging, call recording, privacy, and sector-specific laws.
- Honor do-not-call requests, opt-outs, quiet hours, suppression lists, and applicable A2P registration requirements.
- For U.S. telemarketing, screen and honor applicable federal, state, and entity-specific do-not-call requirements; obtain the consent required for automated or prerecorded calls; use accurate caller ID; observe applicable local-time calling limits; and maintain the records required for your campaign.
- Clearly disclose when a person is interacting with an AI system where required by law or policy.
- Provide any required notice and obtain any required consent before recording or transcribing a call.
- Use accurate caller identification and do not impersonate a person, business, or government entity.
- Do not use the Service for emergency services or as the sole basis for high-impact legal, medical, credit, employment, housing, insurance, or similar decisions.
You are responsible for your scripts, recipient lists, campaign settings, disclosures, and transfer or scheduling instructions. Smart Lead Lab may suspend communication features when we identify suspected abuse, invalid consent, provider restrictions, or legal risk.
6. Insurance Services Disclaimer
Important: Smart Lead Lab provides technology tools to assist insurance agents and brokers. We are not an insurance company and do not provide insurance advice, underwriting decisions, or guarantee quote accuracy.
- Quotes generated are estimates only and subject to carrier approval
- Final underwriting decisions are made solely by insurance carriers
- Users must be properly licensed to sell insurance in their jurisdiction
- Compliance with insurance regulations is the user's responsibility
7. Data and Privacy
Your privacy is important to us. Our Privacy Policy explains how we collect, use, and protect your information. By using the Service, you consent to the collection and use of your information as outlined in our Privacy Policy.
Communication features may process caller and recipient phone numbers, call and message metadata, interaction history, AI prompts and responses, transfer or appointment details, and, when enabled, recordings and transcripts. We and our service providers process this information to deliver the requested communications, maintain security, troubleshoot failures, enforce compliance controls, and support your account.
These features rely on service providers that may include Twilio for telephony and messaging, OpenAI for AI response generation, ElevenLabs for voice generation, Google Firebase for application data and storage, Vercel for hosting and compute, and Sentry for error and diagnostic monitoring. Review the Privacy Policy for more information about retention, deletion requests, and international processing.
If you connect Google Calendar, you authorize Smart Lead Lab to access only the calendar data and permissions necessary to display availability, synchronize appointments, and create, update, or delete calendar events that you initiate through the Service. You may disconnect Google Calendar in Calendar settings at any time; disconnecting stops future API access, subject to limited retention described in the Privacy Policy.
8. Intellectual Property
The Service and its original content, features, and functionality are owned by Smart Lead Lab, LLC and are protected by international copyright, trademark, patent, trade secret, and other intellectual property laws.
You retain ownership of content you create using our AI tools. However, you grant us a limited license to use, store, and process your content to provide the Service.
9. AI Features, Third-Party Providers, and Customer Responsibility
The Service uses automated systems and third-party providers for features such as artificial intelligence, voice generation, telephony, messaging, payment processing, hosting, storage, calendar connections, and monitoring. Providers may change, delay, decline, interrupt, limit, or produce inaccurate, incomplete, offensive, or otherwise unsuitable outputs or results. AI-generated content, recommendations, summaries, transcripts, call behavior, and other outputs are probabilistic and require your review and approval before use.
You are solely responsible for the data, prompts, business information, products and services, scripts, recipient lists, outreach instructions, transfers, appointments, and decisions you submit or authorize through the Service. You must independently verify outputs and maintain any human oversight appropriate to your use case. Smart Lead Lab does not guarantee accuracy, availability, delivery, lead quality, conversions, appointments, revenue, business outcomes, or regulatory compliance.
To the maximum extent permitted by law, Smart Lead Lab is not responsible for acts, omissions, policies, outages, failures, decisions, content, or outputs of third-party providers or AI systems, or for actions taken by you, your users, recipients, or other third parties in reliance on the Service or its outputs. This section does not limit rights or liabilities that cannot be waived under applicable law.
10. Limitation of Liability
In no event shall Smart Lead Lab, LLC, nor its directors, employees, partners, agents, suppliers, or affiliates, be liable for any indirect, incidental, special, consequential, or punitive damages, including without limitation, loss of profits, data, use, goodwill, or other intangible losses, resulting from your use of the Service.
To the maximum extent permitted by law, this includes lost business, revenue, profits, sales, leads, appointments, opportunities, conversions, reputation, or anticipated savings, and losses arising from AI-generated output, calls, messages, transfers, scheduling, provider outages, delivery failures, or reliance on the Service. Nothing in these Terms excludes liability that cannot be excluded under applicable law.
11. Service Availability
We strive to maintain high availability but do not guarantee uninterrupted service. We may temporarily suspend access for maintenance, updates, or other operational reasons. We are not liable for any losses due to service interruptions.
12. Termination
We may terminate or suspend your account and bar access to the Service immediately, without prior notice or liability, under our sole discretion, for any reason whatsoever, including without limitation if you breach the Terms.
Upon termination, your right to use the Service will cease immediately. All provisions which by their nature should survive termination shall survive termination.
13. Changes to Terms
We reserve the right to modify or replace these Terms at any time. If a revision is material, we will provide at least 30 days' notice prior to any new terms taking effect. Continued use of the Service after changes constitutes acceptance.
14. Governing Law
These Terms shall be interpreted and governed by the laws of the State of Delaware, United States, without regard to its conflict of law provisions. Any legal action or proceeding shall be brought exclusively in the federal or state courts located in Delaware.
